Driver who struck, killed pedestrian won’t face charges

ACWORTH — No charges will be filed against the driver who struck and killed a pedestrian late last week.

Lt. Jay Baker, spokesman with the Cherokee Sheriff’s Office, said there was “no indication the driver was speeding or impaired at the time of the collision,” which killed Herrera Mendez, 52.

The Acworth man died after he was hit by a Nissan sports utility vehicle traveling westbound on Highway 92 just west of Wade Green Road.

Baker said first responders arrived on the scene around 9:30 p.m. Friday night.

He noted the man was crossing the highway in a “dimly-lit area and not utilizing a crosswalk” when he was hit by car.

Mendez was pronounced dead at the scene.

The Cherokee Sheriff’s Office’s Traffic Enforcement Unit continues to investigate the accident.

Why is that necessary? Don't you think the person is dealing with enough trauma and grief as it is? If it's so important to know, it's a matter of public record and can be found at the courthouse.

The driver's name is necessary for a complete news report of the incident and to insure that some connected person is not getting preferential treatment with the lack of charges. By Kennesaw's logic, why publish the victim's name?
